You Are Still Able To Advertise With Us.

Our site does not offer estate agency services we are an advertising portal therefore you are able to advitise with us without being in breach of your sole agency or multiple agency agreement. Advertising with Private Eye Property is the same as advertising in your local news paper, shop window or emailing people about your property.

In December 2005 'The Office of Fair Trading' issued guidance on how to determine whether a property internet site was in fact an Estate Agent or not. If a site was really an Agent then your would be liable to pay £1000s in commission to your Estate Agent.

There are three basic activities introduced by The Office of Fair Trading Standards which would make a private sales sites qualify as an agent:

  1. Sending out property particulars and arranging viewings (you arrange viewings yourself) 
  2. Receiving and fielding queries from potential sellers or buyers and passing on details to your clients (you field queries from potential buyers or tenants yourself) 
  3. Providing clients with a 'For Sale' board and/or putting it up outside their property containing the website contact details (your number would be used) 

There are three common types of agreement:

  • Sole Agency - refers to your appointed Estate Agent - the only agent with the right to sell your property. You should be able to sell the property yourself without paying the agent a fee. There fore you are able to advertise on Private Eye Property as we are not an Agent, provided that the buyer was not introduced to you through the Estate Agent during the contract period.
  • Multiple Agency - This is the same as sole agency except you have instructed a number of agents rather than just one. Therefore you are able to advertise on Private Eye Property as we are not an Agent
  • Sole Selling Rights - This means that your agent is the only person allowed to sell your property so you will still have to pay their fees even if you do advertise with us.

Make sure you check which type of agreement you have signed and also make sure that your agent has not slipped in an "Exclusion of Private Internet Advertising" clause.
